Development Services Agreement

1. Introduction

These Terms and Conditions ("Agreement") govern the development services provided by Federico Crespo ("Developer", "I", "me") through crespa.dev to the client ("Client", "you").

By purchasing any service or token package, you agree to be bound by these terms. Please read them carefully before making a purchase.

2. Service Description

I provide AI-powered development services using a "Human + AI" methodology. This means:

  • A real human developer (me, Federico) works on your project
  • I use AI tools (Claude by Anthropic) to accelerate development
  • All code is reviewed, tested, and validated by me personally
  • You get the benefits of both human judgment and AI speed

2.1 Service Tiers

Reactive (Basic Tier)

  • - Development work as specified
  • - Code review and quality assurance
  • - Bug fixes related to delivered work
  • - Email support during the project
  • - Live viewing access during active work hours

Proactive (Premium Tier)

  • - Everything in Basic Tier, plus:
  • - Strategic technical guidance
  • - Technical roadmap and planning
  • - Project proposals and architecture consulting
  • - Priority support and communication

3. Live Viewing Feature

All clients receive access to a secure live viewing link when I'm actively working on their project.

3.1 What You Can See

  • Real-time code being written in the terminal/editor
  • File creation, modification, and deletion
  • Terminal commands and their output
  • Tool calls and AI interactions
  • Build and deployment processes

3.2 Communication During Sessions

  • The live viewer itself is read-only (you observe but don't interact directly)
  • You can contact me via Slack or email during active work sessions
  • I regularly check for client messages and can adjust work in real-time
  • Response time during active sessions: typically within minutes

3.3 Security

  • Each client receives a unique, secure viewing link
  • Links are not shareable and are tied to your project
  • Sensitive credentials are never displayed in the terminal
  • Session recordings are not stored unless explicitly requested

4. Pricing & Payment

4.1 Pricing Structure

  • Prices are based on estimated AI tokens and development hours
  • All prices are in USD and include payment processing fees
  • Two tiers available: "Reactive" and "Proactive"
  • Token packages offer better rates for larger projects

4.2 Payment Terms

  • Payment is required upfront before work begins
  • Payment secures your spot in the development queue
  • Accepted methods: Credit/Debit cards via Stripe
  • All transactions are secure and PCI-compliant

5. Timeline & Delivery

5.1 Queue System

  • Payment reserves your spot in the development queue
  • Work typically begins within 1-3 business days
  • You'll receive an email notification when work starts
  • Your live viewing link is sent at the same time

5.2 Working Hours

  • Active development hours: Monday-Friday, flexible schedule
  • Time zone: Argentina (GMT-3)
  • Live viewing is available whenever I'm actively coding on your project
  • Async communication available outside active hours

5.3 Deliverables

  • All code is delivered via Git (GitHub, GitLab, or your preferred platform)
  • Documentation for implemented features
  • Deployment to staging/production as agreed
  • Summary of work completed and any recommendations

6. Refunds & Cancellations

6.1 Before Work Begins

Full Refund Available

If I haven't started work on your project yet, you can request a full refund at any time. No questions asked.

6.2 After Work Begins

Prorated Refund

Once work begins, refunds are prorated based on unused hours/tokens. The amount already used will be deducted from your refund.

6.3 Non-Refundable Situations

  • Work that has been completed and delivered
  • Tokens that have been consumed
  • Custom work that cannot be reused

6.4 How to Request a Refund

Contact me via the contact form with your order details. Refunds are typically processed within 5-10 business days.

7. Client Responsibilities

To ensure smooth project delivery, you agree to:

  • Provide clear requirements and specifications for the work
  • Grant necessary access to repositories, hosting, and services
  • Respond to questions and feedback requests in a timely manner
  • Review and approve deliverables within 7 days of completion
  • Provide accurate contact information for communication
  • Not share your live viewing link with unauthorized parties

8. Intellectual Property

8.1 Code Ownership

  • All custom code written specifically for your project belongs to you
  • You receive full rights to use, modify, and distribute the code
  • I retain no ownership claims over your custom code

8.2 Third-Party Components

  • Open-source libraries remain under their original licenses
  • I will inform you of any licensing requirements for dependencies
  • Pre-existing frameworks and tools maintain their original ownership

8.3 Portfolio Rights

I reserve the right to showcase non-confidential aspects of the work in my portfolio, unless you explicitly request otherwise in writing.

9. Limitations & Disclaimers

9.1 Scope Limitations

  • Work is limited to the scope agreed upon at purchase
  • Additional features or changes may require additional payment
  • Estimates are based on typical scenarios; complex edge cases may require more time

9.2 No Guarantees

  • I cannot guarantee specific business outcomes (revenue, traffic, etc.)
  • Third-party service availability is outside my control
  • Compatibility with future updates to frameworks/platforms is not guaranteed

9.3 Liability

My liability is limited to the amount paid for services. I am not liable for indirect, consequential, or incidental damages arising from the use of delivered work.

10. Communication

10.1 Primary Channels

  • Contact form on crespa.dev (for formal communication)
  • Slack: Available during active work sessions
  • Calendly: For scheduling calls and meetings

10.2 Response Times

  • During active sessions: Within minutes via Slack
  • Email: Within 24-48 hours on business days
  • Urgent matters: Please mark emails as urgent

11. Modifications to Terms

I reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of services after changes constitutes acceptance of the new terms.

For existing projects, the terms in effect at the time of purchase will apply unless you agree to updated terms.

12. Governing Law

These terms are governed by the laws of Argentina. Any disputes will be resolved through good-faith negotiation first. If resolution cannot be reached, disputes will be subject to the jurisdiction of courts in Buenos Aires, Argentina.
